1. General provisions
1.1. Terms and definitions:
1.2. These Terms and Conditions for the Sale of Goods in the Online Store, which are understood as a set of conditions set out below, as well as the conditions posted on the Seller's Website, regulate the relationship between the Seller and the Buyer and determine the procedure for the retail sale of Goods through the Online Store.
1.3. The Seller reserves the right to unilaterally amend these Terms and Conditions without further notice. The Buyer is responsible for reviewing the Terms of Sale and their subsequent changes published on the Website.
1.4. The relationship between the Buyer and the Seller is governed by these Terms and Conditions, as well as the laws and regulations in force in the Russian Federation (RF):
- The Civil Code of the Russian Federation;
- The Law of the Russian Federation "On Consumer Rights Protection" dated 07.02.1992 No. 2300-I;
- Rules for the sale of goods by remote means, approved by Decree of the Government of the Russian Federation dated 27.09.2007 No. 612.
1.5. The Buyer agrees to these Terms and Conditions (with consideration to periodic changes to them, which are posted on the Seller's Website) at the time of registration on the Website by clicking on the "Register" button and ticking the appropriate boxes in the registration form.
By placing an Order without registering on the Website, the Buyer confirms that he has read and agrees to these Terms and Conditions.
1.6. The Seller independently sets the price of the Product presented on the Website. The price of the Product is indicated in Russian rubles and includes VAT at the applicable rate according to the current legislation of the Russian Federation.
1.7. The delivery dates indicated on the Website, information about the availability of Goods in the Seller's warehouse, as well as the illustrations (appearance) of the goods, including the color, are of a reference (informational) nature and do not give rise to any legal consequences for both the Seller and the Buyer.
1.8. All Products posted on the Seller's Website have the necessary declarations/certificates for their sale in accordance with the current legislation of the Russian Federation.
2. Registration on the website and ordering
2.1. Both registered and unregistered Buyers can place an Order on the Website.
2.2. The buyer has the right to register only 1 (one) time, i.e. he can have only one Personal Account linked to one phone number and one email address. Upon registration, the Buyer receives a login and password to his Personal Account. Individual identification of the Buyer avoids unauthorized actions by third parties on behalf of the Buyer and opens access to additional services on the Site. The Seller undertakes not to transfer the Buyer's username and password to third parties.
2.3. The Buyer is responsible for the accuracy and reliability of the information provided during registration. The Seller is not responsible for non-fulfillment of obligations in case of incorrect information provided by the Buyer.
2.4. The Buyer undertakes not to disclose to third parties the login and password provided by him during registration on the Website or received by him as a result of the registration procedure from the Seller. If the Buyer has any suspicions about the security of his login and password or the possibility of their unauthorized use by third parties, the Buyer should immediately notify the Seller using the contact information provided on the Website.
2.5. The Product can be ordered in several ways (detailed information is provided on the Seller's Website in the section https://solorussia.com/information/how-to-buy/):
a) by adding the Product to the shopping cart on the Seller's Website, with further self-registration,
b) by e-mail to the address indicated on the Seller's Website,
c) by calling the phone number listed on the Seller's Website.
2.6. After completing the Order, the Seller can clarify the Order details by contacting the Buyer at the phone number provided by him.
2.7. The seller confirms acceptance of the order by changing the order status in his personal account on the website, by e-mail and/or by phone. The Seller has the right to refuse to accept the order or restrict the payment method if the order raises reasonable doubts about the reliability and accuracy of the specified data or payment method.
2.8. If the Order cannot be confirmed by the Seller if the required quantity of the ordered Goods is not in the Seller's warehouse, the Seller informs the Buyer about this by calling the phone number indicated by him. The Buyer may agree to accept the Product on the Seller's terms (for example, in the quantity available to the Seller), change the Order and replace the Product with a similar one, or cancel this item of the Product as part of the Order. In case of non-receipt of a response from the Buyer within 3 (three) calendar days from the date of notification, the Seller has the right to cancel the Order in whole or in part by sending a message to the Buyer's email address specified during registration.
2.9. In case of full or partial cancellation of the pre-paid Order, the value of the cancelled items of the Goods is returned by the Seller to the Buyer to the bank account from which the payment was made within 7 (seven) calendar days.
2.10. The Seller has the right to unilaterally set the maximum number of items in one Order, the maximum cost of one Order, limit the forms of payment for an Order, as well as the number of Orders sent to one Buyer at a time.
2.11. Orders on the Website are accepted around the clock throughout the year. Orders placed on Friday after 3 p.m., Saturday, Sunday, and public holidays will be collected for shipment on subsequent business days. The order assembly time is 1-2 business days.
3. Payment
3.1. The price of the Product is indicated on the Website and can be changed unilaterally by the Seller. At the same time, the price of the Product ordered by the Buyer cannot be changed after confirmation and payment of the Order.
3.2. Payment methods are indicated on the Seller's Website in the section https://solorussia.com/information/payment/ and are available for selection during the checkout process, depending on the terms of the Order.
3.3. The Seller has the right to provide the Buyer with discounts on the Product, establish a bonus program and conduct other marketing campaigns. The types of discounts, bonuses, the procedure and conditions for their accrual, as well as the procedure, conditions and terms of promotions are indicated on the Seller's Website in the section https://solorussia.com/information/solo-club / (Rules of the Solo Club loyalty program) and can be changed unilaterally by the Seller.
4. Delivery
4.1. Orders are delivered within 1-2 business days after payment is received. If payment for the Order is not received, the shipment is postponed until the payment is received.
4.2. The product is delivered by the Delivery Service. The shipping methods are listed on the Website in the section https://solorussia.com/information/delivery/. The available delivery methods depend on the Buyer's delivery address, and choosing a specific delivery method means that the Buyer agrees to the appropriate delivery terms.
4.3. The seller is not responsible for delays in delivery that may occur due to unforeseen circumstances that are not his fault.
4.4. If the Buyer specifies an incorrect delivery address or other contact information that does not allow the Order to be delivered, the Buyer pays for the repeated delivery of the Order.
4.5. Simultaneously with the transfer of the goods to the Buyer, all necessary information about the Goods, the order and timing of its return, and the consignment note are transmitted.
4.6. When transferring the Order, the Buyer is obliged, in the presence of a representative of the Delivery Service, to inspect the integrity of the individual package and the presence of external damage on it. After making sure that the package is safe and that there are no signs of external damage on it, open the individual package and check the availability of the Product(s) in it. After making sure that the ordered Product(s) is available and that there are no signs of mechanical or other damage, check the article and size of the received Product(s) with the article and size indicated in the accompanying document (invoice), check the package and color of the Product(s). The fact that the signature is affixed to the Delivery Service's consignment note indicates that the Buyer has accepted the Goods, and has no complaints about the appearance, configuration, or cost of the Goods(s) in the Order. The Buyer's signature on the consignment note excludes further claims against the Seller, with the exception of claims related to the presence of manufacturing defects in the Goods.
4.7. If the Buyer chooses to receive the Order at the order pick-up point or parcel locker as the delivery method, the Buyer undertakes to receive the Order within 7 (seven) calendar days from the date of receipt by the Buyer of the notification of the transfer of the Order to the order pick-up point / parcel locker. Failure to receive the Order within the prescribed period is considered the Buyer's refusal to conclude / execute the purchase and sale agreement and is the basis for cancellation of the Order by the Seller. The money for the non-received Goods is returned to the Buyer in accordance with the terms posted in the section https://solorussia.com/information/return-and-exchange / of the website, and the cost of the Order delivery is not refunded.
4.8. Ownership of the Goods and the associated risks are transferred from the Seller to the Buyer at the time of the actual transfer of the Goods to the Delivery Service.
5. Return
5.1. The return of Goods of proper and improper quality is carried out in accordance with the conditions posted on the Website in the section https://solorussia.com/information/return-and-exchange /, as well as the general conditions of return provided for in this section of the Terms and the current legislation of the Russian Federation.
5.2. The basis for accepting a refund request is the submission by the Buyer of a document confirming the purchase of the Goods (a cash receipt).
5.3. In case of complete or partial cancellation of the Order / return of Goods of proper or improper quality, the money paid for the Goods will be returned to the Buyer in accordance with the conditions set out in the section https://solorussia.com/information/return-and-exchange/ of the website.
5.4. The returned product must be sent to the Seller's address in the form (i.e., in the condition and packaging) in which it was delivered to the Buyer. The return delivery of the Goods of proper quality is paid by the Buyer.
6. Privacy protection
6.1. By placing an order, the Buyer agrees to the processing of his personal data solely for the purpose of completing the order.
6.2. The Seller guarantees the confidentiality and protection of the information received in accordance with the current legislation of the Russian Federation. The storage and processing of personal data provided by the Buyer is carried out under the terms of the Personal Data Processing Policy (https://solorussia.com/politika-konfidencialnosti) of the website.
6.3. The Buyer may give separate consent to receive promotional materials from the Seller.
6.4. The Seller undertakes not to transfer information about the Buyer to third parties not related to the fulfillment of obligations to fulfill the Order.
6.5. The buyer has the right to review and correct his data, as well as to request their deletion.
7. Intellectual property
7.1. It is prohibited to use any materials published on the Seller's Website (including photographs and product descriptions) without the Seller's written consent.
7.2. All information provided on the Website, images (photographs, drawings) and other materials and content of the Website related to objects of copyright and related rights are the property of the Seller.
8. Claims
8.1. If the Buyer has any claims regarding the fulfillment by the Seller of the obligations to transfer the Goods stipulated by these Terms and other conditions set out on the Website, such Claims are accepted by the Buyer electronically at the email address sale3@swimsolo.ru.
